US court awards damages to Pinay human trafficking victim

A Rhode Island federal judge has ordered default against an Emirati colonel in a human trafficking civil suit.

The decision paves the way for the award of compensation to Elizabeth Cabitla Ballesteros, according to a statement from the Asian American Legal Defense and Education Fund (AALDEF) which provided legal assistance to the Filipina domestic worker.

In April 2011, Ballesteros filed a civil action against Colonel Arif Mohamed Saeed Mohamed Al-Ali, a former student at the U.S. Naval War College’s International Program from the United Arab Emirates (U.A.E.), for violating federal laws against human trafficking.

“Ms. Ballesteros has shown tremendous courage in taking a stand against the involuntary servitude to which she was subjected,” said attorney Ivy Suriyopas, who leads AALDEF’s Anti-Trafficking Initiative. “She and the countless other domestic workers who are human trafficking survivors in the United States deserve justice.”

Ballesteros worked as one of the domestic workers for the Col. Al-Ali, his wife Samah Alharmoodi, and their five children for several years in the U.A.E. before they asked her to provide child care for their younger children in the United States.

She arrived in Rhode Island in 2010 with a written contract to work five days a week and receive her pay in U.S. dollars.

Instead, Col. Al-Ali subjected her for three months to involuntary servitude, forced labor, peonage, debt bondage, and slavery as a domestic worker in their home, according to the AALDEF statement.

“He did not allow her a single day off work, forbade her from speaking to anyone outside the household, withheld her passport, and sent only occasional wages in dirham currency to her family in the Philippines,” it said.

Ultimately Ballesteros was able to escape and obtain representation from AALDEF’s Anti-Trafficking Initiative.

In 2011, Col. Al-Ali was arraigned by federal prosecutors for one count of committing fraud in foreign labor contracting and one count of making false representations to Immigration and Customs Enforcement.

He was arrested at JFK airport in New York City as he attempted to leave the United States with his family following his release on his own recognizance.

While he was acquitted of the criminal charges in August 2011, the court allowed the civil suit to resume in October.

In early 2012 his attorney moved to withdraw, and Col. Al-Ali has not appeared to defend himself in court. After he failed to appear at an August 8 hearing, U.S. District Judge McConnell ordered default on all counts after Ballesteros made an oral motion.

The court may now schedule a hearing on damages to which Ballesteros is entitled. - The FilAm

Remains of Pinay maid electrocuted in Qatar arrive in PHL

The remains of Marianne Aguilar Jimenez, a Filipina domestic worker who died due to electrocution in Qatar on June 17, arrived in the Philippines on Friday.

The news site SunStar Davao said Jimenez, 34, of Mintal, Davao City died after 95 percent of her body got burned.

Philip Alano of the Overseas Workers Welfare Administration (OWWA) in Doha, Qatar said Jimenez's body was found totall burned.

She was rushed to the trauma intensive care unit of the Hamd Hospital where she lost consciousness and died.

SunStar said Jason Jimenez, the husband of the victim could not believe what happened to his wife and he suspected foul play.

“I believe she was intentionally burned. I once called her and asked about her stay and employment in Qatar. She told me her female employer treats her well except for employer's daughter,” Jason was quoted as saying.

He said he has not yet received his wife's autopsy report which he asked the Department of Foreign Affairs to secure.

He said he has also sought the help from the Philippine Embassy to conduct an independent investigation.

Jimenez, a mother of three, left the Philippines on May 10 this year.

Justice and support

Gil E. Lebria of the migrant workers advocacy group Migrante-Middle East said they also suspect foul play.

“Our government should act on this. The death of a married OFW is never easy,” he said.

Meanwhile, Maria Elvira Ador, OWWA regional director, told SunStar that they are only waiting for the final report to determine the cause of death but they will be handing over at least P120,000.

Tel Aviv, December 28, 2010. Approximately 250 Eritrean refugees have been held captive and tortured for the past month by Hamas in northern Sinai, human rights organization EveryOne reported.

The Italian-based organization sent an urgent plea to the Egyptian government last Thursday, claiming that the refugees, who were making their way to Israel to seek asylum, were captured by human traffickers. The issue of illegal refugees infiltrating through the Egyptian border has been dominating the news in Israel in recent months, but it appears that many meet a dreadful fate even before reaching the Jewish state. The humanitarian aid group reported that the refugees in question encountered Hamas operatives along the route, who promised to smuggle them into Israel for a payment of $2,000. Instead, they were placed in a detention facility on the outskirts of Rafah, an Egyptian town on the Gaza border, demanding their families in Eritrea pay a $10,000 ransom for their release.
 
'Refugees target of organ trafficking'

It was further noted in the statement that eight of the immigrants were killed, and four have gone missing – allegedly being the subject of human organ harvesting and trafficking. About 100 of them were transferred to a 'concentration camp' at an unknown location, perhaps in the Palestinian territories. The captives are beaten, the women and children raped. “The prisoners eat poor food and are forced to drink their own urine,” the statement reads. “Most of the migrants are contemplating suicide.”
 
According to Roberto Malini, who heads EveryOne, the NGO is able to communicate with the Eritreans, some of whom arrived in Italy a few months ago but were sent back to Libya, where they were held for three months. During their stay in Italy they were given cell phones so that they can keep the humanitarian aid group updated along the journey. The captors let the prisoners use the phones to request money from their families.
 The refugees were thus able to relate the poor conditions in which they were being held, and describe their location – a house located near a government building, surrounded by a fruit orchard – and even send photographs of the detention facility.
 
'Egypt took no action'

According to refugees who survived similar journeys and reached Israel, once the ransom is paid, the traffickers escort the prisoners to certain points along the border. Those who are unable to gather the funds will meet a bitter end.
 
EveryOne officials claim that despite their repeated efforts to inform the Egyptian authorities of the dire situation, no action has been taken to remedy it, primarily because terrorist groups are behind the atrocities.
 
“The authorities have still not carried out any inspections of the locations that have been pointed out to them (in the town of Rafah),” the statement reads. “The reason is quite clear… behind the crimes that serve to fund terrorism and to make huge profits for unscrupulous people is a criminal organization so powerful that it is able to challenge and defy governments: the Muslim Brotherhood (the organization Hamas belongs to) and al-Qaeda.”

Charges reveal Hamas involved in migrant smuggling operations

Four Israelis, including one minor, and an East Jerusalem resident were arrested in recent weeks for working with a Hamas operative to extort money from relatives of an Eritrean kidnapped in the Sinai, police revealed on Sunday.
Two of the suspects, Yaakov Grad, 43, of Kfar Yona, and Eliran Moshe, 25, of Netanya, were indicted Sunday at the Jerusalem District Court.
Amad Abu Arar, a Hamas operative who lives in Gaza, allegedly contacted Grad in late August and instructed him to go to Tel Aviv to collect $13,000 from an uncle of an Eritrean migrant captured by Bedouin smugglers on his way to Israel.
The uncle had been played a recording of his nephew begging for his life, and persuaded to pay a ransom.
Grad and Moshe, who both have criminal records, went together to collect the money, and reportedly received NIS 1,500-2,000 for their role in the transaction.
Police believe Grad and Moshe were complicit in at least six other similar transactions, Channel 2 reported.
The indictment alleges that Grad transferred the money to Louis Nasr al-Din, a resident of East Jerusalem and also a suspected Hamas operative, who in turn transferred the money to Abu Arar, who was coordinating with the abductors.
Din was remanded for five days. His attorney, Lea Tsemel, denied that her client was involved in the case.
A third Israeli, Victor Siboni, also of Netanya, was indicted on Sunday and charged with transferring money that he received from Abu Arar to several underworld figures. The money was allegedly collected from Sudanese migrants that Abu Arar helped smuggle into Israel.
A fourth Israel, a teenager, was also arrested in connection with the case, but was released with the court’s consent.
Grad’s attorney, Boaz Kenig, claimed that Grad was unaware that Abu Arar was connected with Hamas. Kenig said that Abu Arar owed Grad NIS 1,500, and Grad acted in good faith, believing that he was receiving the money he was owed.

Human trafficking: Another reason to watch your kid’s online activity (Video)

On September 14, gang leader Justin Strom, was sentenced to 40 years for his part in a sex trafficking conspiracy. And now, the Federal Bureau of Investigations (FBI) is calling attention to yet another avenue for human traffickers to find victims. Focusing upon street gangs, who have realized the profitability of human trafficking, and their new tactic of social networking to find victims.
The FBI cites that this is yet another reason why parents need to keep a close eye on their kids’ involvement with social networking websites. During a three-year period ending in March 2012, members of a violent Virginia street gang used social networking sites, like Facebook and Myspace, to recruit vulnerable teenage girls to work in their commercial sex-trade business or in other words, forced prostitution.
After a multi-agency state and federal investigation, five defendants from the Virginia-based gang, pleaded guilty to various federal charges related to the sex trafficking conspiracy. The leader of the gang, Justin Strom, 27, leader of the Underground Gangster Crips (UGC), was 40 years in prison, while the sentences handed down for the other four defendants totaled 53 years. The Crips originated in Los Angeles in the late 1960s and since then, the gang has splintered into various groups around the country. Law enforcement has seen a number of Crips sets in the U.S. engaging in sex trafficking as a means of making money.
That’s certainly what was happening in Virginia. Strom and his UGC associates would troll social networking sites, looking for attractive young girls. After identifying a potential victim, they would contact her online using fake identities. Then in typical predatory fashion, they would compliment her on her looks, ask to get to know her better, and offer the victim an opportunity to make money from her looks. If the victim expressed interest, Strom or one of his associates would ask for her cell phone number to contact her offline and make plans to meet.
If you’re wondering how a girl, your own daughter perhaps, can fall for flattery from a low-life gang member, keep in mind that even the “devil” can be charming. In the case of Strom and his associates, they lured their victims to meet them in parson and often plied them will alcohol. Thereafter, the victims had to perform a mandatory sexual “tryout” or another words they were raped. After the mental, physical and sexual abuse it wasn’t too difficult to “convince” the victims into engaging in commercial sex. Some of the juvenile victims were threatened with violence if they didn’t perform as directed and many were given drugs or alcohol to keep them sedated and compliant.
According to the FBI, Strom and his associates did not discriminate against their victims. The FBI found that Strom’s victims were from every socio-economic background and ethnicity. This case is far from exceptional. Although gangs still hustle drugs, human trafficking is a far more lucrative business. Whereas you can sell a kilo of coke one time, a girl can be sold over, and over, and over. If you’re afraid for your child, you should be. Al-Shabaab desecrates corpses as allied forces close in on Kismayo

Resentment is sweeping across the city of Kismayo after al-Shabaab militants dragged the bodies of what they say are Somali and Kenyan soldiers through a central square Saturday morning (September 1st).
Dhofo Saeed Hassan, a 43-year-old mother of eight, said al-Shabaab forced her and tens of other families out of their homes in the Fanole area to look at bodies being dragged by a car. Al-Shabaab said the bodies were casualties of a bloody battle in Miido, which Somali and African Union forces liberated from the militants on Friday.
"They showed us four bodies in military uniforms -- two of them were from the Somali National Army while the other two were Kenyan soldiers," Hassan told Sabahi.
Ahmed Hassan Garad, a 26-year-old juice vendor, said al-Shabaab forced residents to close down businesses and schools in order to gather them in Kismayo's central square to watch them drag the bodies through the streets.
Somali government and African Union Mission in Somalia (AMISOM) officials said last week that troops have nearly surrounded the key port city, which al-Shabaab has controlled for the past five years.
Garad said Somali tribal leaders, clerics and human rights activists have condemned al-Shabaab's heinous crimes as a violation of the sanctity of human life and dignity.
"Al-Shabaab has resorted to inhuman and immoral acts…that are far removed from Islam and civilised humanity," Garad told Sabahi.
Kismayo resident Najma Nuh Ibrahim said she saw an al-Shabaab member filming a car dragging the bodies of alleged Kenyan and Somali troops.
"It was a horrible and tragic scene because it is not our tradition to drag the body of a deceased human, blessed with God's grace," she told Sabahi. "For every human that has any morals on the face of this earth, this is a sad and painful tragedy and is a shameful act coming from a fundamentalist, barbaric and backward group that does not know the meaning of the words 'human' or 'humanity'."
"The residents of Kismayo are not happy with the crimes committed by al-Shabaab, which is notorious for shedding human blood and whose leaders are complicit in murders, kidnappings and anonymous assassinations," she said. "Victims sometimes go missing with their fate remaining forever unknown."

Al-Shabaab's twisted and criminal methods

Awade Abdullahi Gabane, a 52-year-old businessman who transports goods between Kismayo and the nearby village of Bulo Haji, said al-Shabaab victimises citizens of Kismayo and subjects them to indiscriminate violence, trying to reach their objectives through twisted and criminal methods.
Gabane told Sabahi that Islam is innocent of such extremism, labelling the practice of dragging and dishonouring bodies as takfiri. Islam requires the decent burial of deceased persons, he said, and condemns torturous or disrespectful acts.
After the battle in Miido, AMISOM said it killed 36 al-Qaeda-linked al-Shabaab militants.
Kenya Defence Forces (KDF) spokesman Major Emmanuel Chirchir announced on Saturday that five KDF soldiers were missing, and three had been flown to Dobley for medical attention. Three of the missing soldiers were found on Sunday, he said, while the whereabouts of the other two remain unknown.
Journalist Faiza Shire Ali said al-Shabaab considers the Kenyan army to be an occupying force, even though the African Union and the Somali Transitional Federal Government reached an agreement in March to merge thousands of Kenyan forces under the AMISOM umbrella.
"The enemies of peace have been losing several strategic locations, including the coastal city of Marka, the capital of Lower Shabelle," she told Sabahi. "They have also been suffering repeated setbacks as well as tragedies and pain inflicted upon the leaders of the movement who have been forced to change their sleeping places every night as they move from one village to another," she said.
"We can see them peering down an abyss as they fall, one after the other, throughout various parts of the country until they are captured by the intelligence services and locked up in the prisons of Mogadishu, Beledweyne and Bosaso," Ali said.
